How to Complete a Power of Attorney Form
A field-by-field explanation of every section in a standard Power of Attorney document.
Form Sections Explained
Don't Miss These Critical Clauses
Always include: (1) A durability clause if you want the POA to remain valid if you become incapacitated. (2) A successor agent in case your primary agent cannot serve. (3) An expiration date if it's a limited POA.
Execution Requirements
- 1
Sign in the Presence of Witnesses
Most states require 2 witnesses who are not the agent, not beneficiaries, and not relatives. Witnesses confirm you signed voluntarily.
- 2
Notarize the Document
A notary public verifies your identity and witnesses your signature. Many banks, UPS Stores, and libraries offer notary services.
- 3
Distribute Copies
Give your agent the original. Provide copies to your bank, healthcare providers, and any institution where the POA will be used.
